• "Job Seeker" refers to users seeking employment opportunities through the Platform.
• "Employer" refers to users posting job listings or seeking candidates through the Platform.
• "Content" refers to all information, data, text, software, music, sound, photographs, graphics, video, messages, or other materials.
• "Account" refers to a unique account created for You to access our Service.

2.1 Eligibility

You must be at least 16 years old to use the Service. By agreeing to these Terms, you represent and warrant that you are at least 16 years of age. If you are under 18, you confirm that you have received permission from your parent or legal guardian to use the Service.

2.2 Account Creation

To access certain features of the Service, you must register for an account. When you create an account, you must provide accurate and complete information. You are solely responsible for maintaining the confidentiality of your account and password, and you accept responsibility for all activities that occur under your account.

2.3 Account Types

The Platform offers two types of accounts:

• Job Seeker Accounts: For individuals seeking employment opportunities, including students and recent graduates.
• Employer Accounts: For companies and organizations seeking to post job listings and hire candidates.

2.4 Account Security

You must immediately notify us of any unauthorized use of your account or any other breach of security. We will not be liable for any loss or damage arising from your failure to comply with this security obligation.

3.1 Prohibited Activities

You agree not to:

• Use the Service for any illegal purpose or in violation of any laws
• Post false, misleading, or fraudulent information
• Impersonate any person or entity or misrepresent your affiliation
• Harass, abuse, or harm another person or group
• Upload or transmit viruses, malware, or other malicious code
• Scrape, harvest, or collect information about other users
• Interfere with or disrupt the Service or servers
• Create multiple accounts for fraudulent purposes
• Post discriminatory content based on race, gender, religion, nationality, disability, sexual orientation, or age
• Circumvent any security features or access controls

3.2 Job Seeker Responsibilities

As a Job Seeker, you agree to:

• Provide accurate and truthful information in your profile and applications
• Keep your resume and profile information up to date
• Respond professionally to employer communications
• Not misrepresent your qualifications, experience, or education

3.3 Employer Responsibilities

As an Employer, you agree to:

• Post only legitimate job opportunities
• Provide accurate job descriptions, requirements, and compensation information
• Comply with all applicable employment and anti-discrimination laws
• Not use the Platform to collect personal information for purposes other than recruitment
• Respect candidate privacy and handle their information responsibly
• Not post jobs requiring payment or fees from candidates

4.1 Your Content

You retain all rights to the content you post on the Platform, including resumes, cover letters, job listings, and company profiles. By posting content, you grant Mewhire a worldwide, non-exclusive, royalty-free license to use, display, reproduce, and distribute your content solely for the purpose of operating and improving the Service.

4.2 Our Content

The Service and its original content (excluding user-generated content), features, and functionality are and will remain the exclusive property of Mewhire and its licensors. The Service is protected by copyright, trademark, and other laws. Our trademarks, logos, and service marks may not be used without our prior written consent.

4.3 Content Moderation

We reserve the right, but not the obligation, to monitor, review, and remove any content that violates these Terms or that we deem inappropriate, offensive, or harmful. We may also suspend or terminate accounts that repeatedly violate these Terms.

5.1 Paid Services

Certain features of the Platform may require payment. If you choose to use paid services, you agree to pay all fees associated with such services. All fees are quoted in USD and are non-refundable unless otherwise stated.

5.2 Subscription Plans

Employers may subscribe to various plans (FREE, PRO, ENTERPRISE, CUSTOM) with different features and pricing. Subscriptions automatically renew unless cancelled before the renewal date. You may cancel your subscription at any time through your account settings.

5.3 Payment Processing

Payments are processed through third-party payment processors. You agree to provide accurate payment information and authorize us to charge your payment method for all fees incurred.

5.4 Refund Policy

Refunds are issued at our sole discretion. If you believe you are entitled to a refund, please contact us within 14 days of your payment with your reason for requesting a refund.

6.1 Job Posting Guidelines

All job postings must:

• Represent a legitimate employment opportunity
• Include accurate job descriptions and requirements
• Comply with all applicable employment laws
• Not contain discriminatory language or requirements
• Not request payment from applicants

6.2 Application Process

When you apply for a job through the Platform, your application materials are sent directly to the employer. Mewhire is not responsible for employer decisions, hiring practices, or employment outcomes. We do not guarantee that you will receive a response or be hired for any position.

6.3 No Employment Relationship

Mewhire is a platform that connects job seekers with employers. We are not an employer, employment agency, or recruiter. We do not make hiring decisions and are not responsible for the employment relationship between users.

Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your personal information. By using the Service, you agree to the collection and use of information in accordance with our Privacy Policy.

You acknowledge that when you submit your application to an employer, your information will be shared with that employer and will be subject to their privacy practices.

8.1 Service "As Is"

The Service is provided on an "AS IS" and "AS AVAILABLE" basis without any warranties of any kind, whether express or implied. We do not warrant that the Service will be uninterrupted, secure, or error-free.

8.2 No Guarantee of Results

We do not guarantee that job seekers will find employment or that employers will find suitable candidates. We are not responsible for the quality, accuracy, or legality of job postings, resumes, or user conduct.

8.3 Limitation of Liability

To the maximum extent permitted by law, Mewhire shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

• Your access to or use of or inability to access or use the Service
• Any conduct or content of any third party on the Service
• Any content obtained from the Service
• Unauthorized access, use, or alteration of your transmissions or content

8.4 Third-Party Content

We are not responsible for any third-party content, websites, or services accessed through the Platform. Any dealings you have with third parties are solely between you and the third party.

You agree to indemnify, defend, and hold harmless Mewhire, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including but not limited to attorney's fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights, including intellectual property or privacy rights; or (d) any content you submit through the Service.

10.1 Termination by You

You may terminate your account at any time by contacting us or using the account deletion feature in your account settings.

10.2 Termination by Us

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease.

10.3 Effects of Termination

Upon termination, all licenses and rights granted to you will immediately terminate. We may delete your account and all associated data. Sections of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.

11.1 Governing Law

You may not assign or transfer these Terms or your rights and obligations under them without our prior written consent. We may assign these Terms without restriction.

12.6 Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials.
